It has just been published the updated 3rd edition of “TRATADO DE DERECHO INDUSTRIAL” by Hermenegildo BAYLOS, with prologue by Professor Dr. Alberto Bercovitz, coordinated by his daughter, María Baylos. This treatise is the only work in Castilian in which Intellectual Property is reviewed in its entirety.

In this third edition, it last for its interest and depth – with the indispensable updates- the revision made by the author, Hermenegildo Baylos, in relation to the intellectual property rights, the theories about its treatment, the historic precedents of protection, the legal nature of such rights and the justification that was found by the author in relation to the unitary treatment of the intellectual property, under the name of “Derecho Industrial”.

As indispensable reference, given the excluding character of the rights over the immaterial goods, also a revision of the essential notions of Antitrust law, in its two aspects of “anti trust” and unfair competition, is included. It is also updated the Spanish positive law regarding Antitrust law, Unfair Competition and Advertising with reference to Directives and EU Regulations.

A group of great experts has fulfilled the update of the Spanish positive law. The protection of the copyrights includes a total update and exposition of the rules that regulate it, with an intense and detailed revision of both, the “Copyright Act” and an exposition of the International Treaties that regulate this area.

The regulation of the different institutions protected by Intellectual Property includes the latest amendments of the Patents and Utility Models Act of 1986, Trade Marks Act of 7 December 2001 and the Designs Act of 7 July 2003, with a revision of the national design that lacked of specific regulation. All the abovementioned, with the necessary references to the Act of 5 June 2006 which, by EU imperative, enlarges the means of protection of the Intellectual Property rights.

The two new Community categories are included: the community trade mark, created by the Community Trade Mark Regulation of 20 December 1993, and the community designs and models, regulated by the Community Design and Models Regulation of 12 December 2001.

Both because of its extent and its doctrinal contribution, this is a work of indispensable reading for all studious of the intellectual creations, because it provides a deep revision of the concepts and doctrines in relation to these creations and, besides, is of great practical utility because of the update of the Spanish positive law that it contains.
